Successful use mobile phone data as evidence in court

 

Creating doubt in the evidence placing the suspect at murder scene

Police used mobile phone data to place the accused at the murder scene.  NZ Mobile Forensics used measurements at the scene of the murder and challenged the Police’s corner stone evidence. NZ Mobile Forensics evidence essentially showed that Police could not conclusively place the accused at the murder scene based on their evidence.

 

Key break through in accuser’s version

An assault case that came down to accusers word against the accused’s word. Mobile phone data provided the key break through in accuser’s version of events, which led to number of charges being dropped.

Successful appeal by creating enough doubt in accuser’s version of events

Ex husband was convicted of assault based ex wife’s injuries and his past history of assault. It came down to accused’s version vs accusor’s version and past assault went against the accused.  Conviction was successfully appealed based on mobile phone data creating doubt in the accuser’s version of events. Subsequently Police dropped the case sighting new evidence.

 

Create enough doubt in circumstantial evidence

Evidence for key offences for a series of aggravated robbery were circumstantial evidence based on mobile phone data. NZ Mobile Forensics was able to create doubt in the circumstantial evidence presented.

Challenging the version of events

Murder conviction was based on the interviews provided by the accused (linking to the murder).  In the appeal mobile phone data was used to challenge the accuracy of the interview provided by the accused.

Prove accused’s innocence

Accused of being accomplice to an aggravated robbery. Mobile phone data was used to show that the accused could not have been at the crime scene based on mobile phone data. Charges were dropped.
